Justices: EPA Can Control Car Emissions
I would bet anytime those four assholes are "in dissent" together, We The People can chalk it up as a Win.The court's four conservative justices -- Chief Justice John Roberts and Justices Samuel Alito, Antonin Scalia and Clarence Thomas -- dissented.

didn't read the dissent yet. I know your take on it, but did they discuss agency deference and Chevron at all?
Okay, I read the dissents. The Thomas dissent concerns statutory construction and priniciples of agency deference under Chevron. I can argue (argue? that would imply you would listen) about this ad infinitum, but at the end of the day, it remains a dispute over gray shades. Further, it gets away from why the case was there to begin with.
But the Roberts dissent goes to standing, the basis for the appeal, and this is where Stevens (true to his nature, that cantankerous old bastard) really opens up a can o' worms. Nasty worms too. By giving a state parens patriae jurisidction in federal court, and allowing "damages" of a minimal sort, the Court has lowered (dropped, really) the bar to those that will turn to litigation when they can't get legislation, and threaten the very concepts of federalism and the meaning of the supremacy clause.
Of course, that keeps the lawyers employed, and lets the oppressed fight the leftist oppression as well as the rightist, so maybe I like this decision after all.
